Federal Disclosures
When representing clients who file for bankruptcy relief, United Legal Advocates LLP is considered a "debt relief agency" as defined by the federal Bankruptcy Code,. 11 U.S.C. § 527 of the Bankruptcy Code requires mandatory written disclosures by debt relief agencies, including bankruptcy attorneys and bankruptcy petition preparers, who assist individuals seeking bankruptcy relief. These disclosures are intended to ensure that individuals filing for bankruptcy are fully informed about the process, their obligations, and potential consequences. Section § 527 mandates several disclosures for debt relief agencies assisting individuals with bankruptcy. The disclosures include ensuring accuracy and completeness of information provided to the court, and including full disclosure of assets and liabilities. Debtors must also state their current monthly income and, in Chapter 13 cases, disposable income, following a reasonable inquiry. Debtors are informed that their information may be audited and failure to provide required information could lead to case dismissal, other sanctions, or criminal penalties, and the differences between Chapter 7 and Chapter 13, the trustee's role, and reaffirming debts. Debt relief agencies must also explain how to identify and value exempt property. These disclosures promote transparency, protect debtors' rights, and help prevent fraudulent information.

Dispute Resolution by Binding Arbitration and Class Action Waiver

You and ULA agree that any dispute, claim, or controversy arising out of or relating to your use of the Site or these Terms (collectively, "Disputes") will be resolved by binding arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
You agree to waive your right to a jury trial and to have any Dispute resolved in court. You also agree to waive your right to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and ULA otherwise agree in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of any class or representative proceeding.
The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Consumer Arbitration Rules (the "AAA Rules") then in effect.
