STOP
FORECLOSURE
&
REPOSSESSION
Facing foreclosure or repossession is a nightmare, but the attorneys at United Legal Advocates act swiftly to protect your home, car, and other essential assets. Our same-day emergency filings trigger an automatic stay under 11 U.S.C. § 362, halting auctions, seizures, and creditor actions instantly. Time is critical—our 24/7 availability ensures we stop creditors before it’s too late.
The Foreclosure Timeline
Foreclosure follows a strict timeline:
-
Day 1: Notice of Default (NOD) recorded after missed payments. The foreclosing lender must wait 90 days before they can record the Notice of Sale (NOS)
-
Day 91+: Notice of Sale may be recorded and sets an auction date at least 21 days from the date of recording the NOS.
-
Auction Day: The home is sold if no action is taken.
Filing bankruptcy before the auction triggers the automatic stay, stopping the sale. Post-auction, with few exceptions, it’s often too late to reverse the outcome, so don’t delay.
How We Stop Foreclosure
-
Chapter 13 Power: Rolls missed mortgage payments into a 3–5-year repayment plan, bringing you current and out of default.
-
Lien Stripping: Removes underwater second mortgages in Chapter 13 if your home’s value is less than the first mortgage balance, reducing your debt load.
-
Emergency Filings: We file electronically in under two hours, even on weekends, to stop auctions. We make every effort to stop the sale—our success rate in emergency filings is exceptionally high.
Stopping Repossession
If your car or other secured assets (e.g., appliances, work equipment) are at risk, we have options:
-
Chapter 7: Reaffirm the loan to keep the asset or redeem it by paying its current value. For example, a $15,000 car loan on a $10,000 car can be redeemed for $10,000.
-
Chapter 13: Cram down the loan to the asset’s value (for cars purchased over 910 days ago) or include payments in the plan to prevent repossession.
-
Negotiation: In Chapter 7 bankruptcy, we may negotiate with lenders to reaffirm loans or modify terms like lowering your interest rate.
